New Hazardous Waste Management Rules Effective March 17 - Mar 14, 2008: On March 7, 2008, a set of amendments to the Michigan hazardous waste management administrative rules under Part 111 were filed with the Michgian Department of State, Office of the Great Seal. The new rules become effective on March 17, 2008. The complete new rules are availalbe on-line along with a color-coded document indicating all changes (See links below).    
     The rules package contains amendments based on both changes to the federal Hazardous Waste Management Program administered pursuant to the Resource Conservation and Recovery Act of 1976, as amended by the 1984 Hazardous and Solid Waste Amendments, and recommendations from the Michigan Department of Environmental Quality (MDEQ), regulated community, and general public (state-initiated amendments). The amendments related to the federal program address air emission standards, hazardous waste identification and listing, manifesting, testing and monitoring standards, universal wastes, wastewater treatment exemptions, hazardous waste combustors, and burden reductions initiatives. The state-initiated amendments pertain to hazardous waste identification and listing, hazardous waste exemptions, universal wastes, construction permit application content, manifesting, consistency with the state's storage and handling of flammable and combustible liquids regulations, and updates to adoption by reference information. In general, all of the amendments are aimed at reducing the rate if noncompliance with existing state program requirements and providing increased protection of human health, safety, welfare, and the environment.

Haz Waste Rules & Public Hearing
- Sep 17, 2007: MDEQ has developed proposed amendments to the hazardous waste management rules (SOAHR 2006-065EQ). A public hearing to solicit comments on the amendments is being held on October 23, at 1:30 PM, in the ConCon Conference Room, Constitution Hall, Atrium South, 525 West Allegan Street, Lansing. The rules are necessary for the department to maintain its Federal authorization from U.S. EPA.
    MDEQ indicates that the amendments improve the overall quality of the rules; reduce regulatory barriers, resource demands, and some of the regulatory burdens on the regulated community; and provide flexibility, streamlined requirements, and the clarity necessary to alleviate confusion and inconsistent interpretations. Written comments on the rules may be submitted no later than October 30, 2007, to MDEQ, Waste and Hazardous Materials Division, P.O. Box 30241, Lansing, Michigan 48909-7741.
    As a whole, the proposed rules have the potential to impact approximately 12,650 conditionally exempt small quantity generators, 3,700 small quantity generators, 700 large quantity generators, 160 hazardous waste transporters, and 245 hazardous waste treatment, storage, or disposal facilities located, or doing business, in Michigan.

Proposed Hazardous Waste Rules Revision - Nov 8, 2006: By letter dated October 30, 2006, the MDEQ Waste and Hazardous Materials Division (WHMD) notified persons on the Division's "Short List" of a working draft of proposed revisions to the Part 111 Hazardous Waste Management Rules. The 139-page package contains revisions that are necessary for the State to maintain its Federal authorization to administer its Hazardous Waste Management Program in lieu of the Federal Program under RCRA of 1976 as amended by HASWA of 1984. WHMD said, "In addition, the Package includes revisions to improve the overall quality or the rules, both in terms of clarification of existing requirements and areas of program coverage, and to reduce some of the regulatory burdens on the regulated community by providing streamlined and flexible requirements."

    The Package is being offered to members of WHMD's "Short-List" in both electronic and hard copy format. The electronic format indicates the revisions based on Federal program changes in red text and those based on MDEQ and public recommendations in blue text. WHMD is accepting written comments on the Package until 5:00 PM December 15, 2006 (See below). Upon receipt of all comments, WHMD will review the comments and contact Short List members, as necessary, to discuss specific comments. WHMD also notes that Short List members that do not respond with comments or do not notify WHMD of their intent to remain on the Short List will be removed from the list. Dec 16, 2004: HAZARDOUS WASTE MANAGEMENT PROGRAM ADMINISTRATIVE RULES PROMULGATED PURSUANT TO PART 111, HAZARDOUS WASTE MANAGEMENT, OF MICHIGAN'S NATURAL RESOURCES AND ENVIRONMENTAL PROTECTION ACT, 1994 PA 451, AS AMENDED (ACT 451). Effective December 16, 2004 (click here). MDEQ, Waste and Hazardous Materials Division, prepared a comprehensive rules report which explains the amendments to the rules. New Haz Waste Rules Effective Very Soon - Dec 7: The comprehensive revisions to the NREPA Part 111 administrative rules (ORR# 2003-007 EQ), originally proposed on May 5, 2004, by MDEQ Waste and Hazardous Materials Division (WHMD) should be eligible for filing with the Secretary of State, Office of the Great Seal, on December 8, 2004, and could become effective early next week. Status Of Part 111 Rule Changes - Aug 18: MDEQ Waste and Hazardous Materials Division reports that the current draft of the rules and the associated public hearing report are under consideration by the Office of Regulatory Reform (ORR).  MDEQ is awaiting approval to submit the rules to the Legislative Service Bureau (LSB) for formal certification.  The goal is still to have the rules in place by the end of the calendar year at the latest. Proposed Hazardous Waste Rules - May 5: MDEQ Waste and Hazardous Materials Division (WHMD) is proposing revisions to the NREPA Part 111 administrative rules. WHMD indicates that the rules are necessary for the State to maintain its Federal authorization from U.S. EPA to administer the State program in lieu of Federal regulations. WHMD says, Additionally, the revisions improve the overall quality of the rules, incorporate administrative revisions resulting from statutory changes, and reduce some of the regulatory burdens.  WHMD has prepared a document, Report to Joint Committee on Administrative Rules, which contains background on the rules process, a section summarizing the revisions and a copy of the proposed rules in strike/bold format and distinguishing Federal from State recommended changes. To obtain copies of the report, send a check of money order payable to "State of Michigan" in the amount of $21.75 to cover the cost of copying and include a stamped ($3.85), 10"x13" self-addressed envelope capable of holding 162 pages of 8.5"x11" paper. Comments on the rules must be submitted by 5:00 PM June 15, 2004.
